Your guide towards a sustainable future

I had a great experience with Ostrovsky Law, communication and service was excellent. Everything was explained to me in a professional and personal manner. Highly recommend using their services for family law.

~ D.P

God sent Danielle M. Ostrovsky “Danielle was a beacon of hope to me at a time when my options appeared limited. I thought the likelihood of a satisfactory resolution seemed nigh on impossible because it appeared that a lot of time, men get the short end of the stick. Not only was she able to defend me from an unjust divorce after my motorcycle accident, where it appeared that I wouldn’t fully recover. She stood in the gap and fought for me. As a result, I was granted equal shared custody of my son. She was a beast in the courtroom, yet her calm and empathetic demeanor outside offered emotional succor to myself and those I care about most. I am eternally grateful for her service, and I hereby recommend Mrs. Ostrovsky without reservation.

Child Support Adjustment

In Florida, child support is open to modification, requiring the filing of a Petition for Modification of Child Support. This involves demonstrating a substantial change in circumstances since the last order, such as an income adjustment.

Alimony Modification

Florida permits alimony modification under specific conditions, necessitating proof of a significant change not initially considered in the original alimony order, such as income fluctuations, job loss, illness, or remarriage. Given the complexity of the court system, having a knowledgeable attorney is crucial.

Modifications FAQs

Yes, child support can always be modified in Florida, so long as certain factors exist and are alleged in the modification action. In order to modify child support, there must be a substantial change in circumstances since the original court order or agreement was entered, such as a change in income of one of the parents.

Alimony can be modified in amount and sometimes duration in certain circumstances depending on the type of alimony that was awarded. However, if a Marital Settlement Agreement was signed by the parties and it expressly states that alimony is non-modifiable, then alimony cannot be modified. There are certain factors that must be met in order to modify alimony such as a substantial change in income of one of the parties that was not contemplated at the time that the divorce was finalized.

In most cases, yes. To seek a modification, you typically need to file a petition with the court and provide evidence supporting your request for a modification. The court will then review the case and make a decision.
